Terms and Conditions
These Terms and Conditions define the rules for access to and use of the COM3 IT Solutions platform, including account conduct, service boundaries, billing and commercial assumptions where applicable, and dispute-related framework language.
Effective date: April 7, 2026
1. Acceptance of terms
By accessing, activating, or using the platform, you agree to these Terms and Conditions, the End User License Agreement, the Privacy Policy, and any additional customer-facing policies or order documents that apply to your organization’s services.
If you are using the platform on behalf of a company, school, nonprofit, or other entity, you represent that you have authority to act on behalf of that entity within the scope of your assigned access.
2. Eligibility and access control
Platform access is intended for business and administrative use by authorized users who are at least 18 years old or who otherwise have lawful authority and supervision to use the service on behalf of an organization.
COM3 IT Solutions may require invitation-only onboarding, identity verification steps, multifactor authentication, or domain-based controls before allowing access to certain workflows or data classes.
3. Service boundaries
The platform may include customer portals, ticketing, compliance workspaces, device and asset views, billing views, integrations, document workflows, reporting, and other managed-service functionality. Not every feature is included in every subscription, package, or statement of work.
Feature availability may depend on subscribed modules, account role, tenant entitlements, third-party dependencies, and administrative configuration.
4. User responsibilities
You are responsible for the accuracy of the information you submit, the legality of your use, and ensuring that your actions in the platform are consistent with your organization’s internal policies, contractual obligations, and applicable law.
- Maintain current and accurate account details.
- Use strong authentication practices and protect your login credentials.
- Review tickets, approvals, billing actions, and administrative changes carefully before submission.
- Promptly report suspected security incidents, billing discrepancies, or unauthorized activity.
5. Payments, subscriptions, and commercial terms
If the platform includes paid add-ons, subscriptions, or transaction-driven services, charges, billing cadence, renewal timing, and scope assumptions are governed first by the applicable customer agreement, proposal, quote, service order, statement of work, or invoice.
Platform references to product modules, add-ons, or activation states are informational and operational in nature and do not independently amend a signed commercial agreement unless COM3 IT Solutions expressly states otherwise in writing.
6. Suspension and acceptable use enforcement
COM3 IT Solutions may investigate misuse and may suspend or restrict access when necessary to preserve security, platform integrity, contractual compliance, or legal compliance. Where appropriate, COM3 IT Solutions may coordinate corrective action through the customer’s designated administrators.
7. Confidentiality
Users may encounter sensitive technical, commercial, security, personal, or operational information belonging to COM3 IT Solutions, the customer, or third parties. You agree to protect confidential information and to use it only for legitimate, authorized business purposes connected to the platform.
8. Availability and support
COM3 IT Solutions will use commercially reasonable efforts consistent with its service model to maintain platform availability and supportability, but it does not guarantee uninterrupted or error-free operation unless such commitments are expressly stated in a separate written agreement.
Maintenance windows, emergency response actions, third-party outages, force majeure events, abuse investigations, and dependency failures may affect availability.
9. Disclaimers and liability framework
Except as expressly stated in a controlling written agreement, the platform is provided without warranties of uninterrupted availability, fitness for a particular workflow, or error-free operation. To the maximum extent permitted by law, COM3 IT Solutions will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of the platform.
10. Governing law and updates
These Terms and Conditions are governed by the laws of the State of California, excluding conflict-of-law rules, unless a controlling written customer agreement states otherwise.
COM3 IT Solutions may update these terms from time to time. Material updates may be posted in the platform, on a linked legal page, or communicated through an administrative notice. Continued use after an effective date constitutes acceptance of the updated terms to the extent permitted by law.
